ACCEPTABLE USE POLICY

1. User's Acknowledgment and Acceptance of this Acceptable Use Policy

Ka-Ching Club, Inc. ("Us", "Our" or "We") provides the Kitchen41.com site and various related services (collectively, the "site") to you, the user ("You", "Your" or "User"), subject to your compliance with all the terms, conditions, and notices contained or referenced herein (the "Acceptable Use Policy"), as well as any other written agreement between us and you. In addition, when using particular services or materials on this site, users shall be subject to any posted rules applicable to such services or materials that may contain terms and conditions in addition to those in this Acceptable Use Policy. All such guidelines or rules are hereby incorporated by reference into this Acceptable Use Policy.

This Acceptable Use Policy is effective as of December 12, 2012. We expressly reserve the right to update or change this Acceptable Use Policy from time to time without notice to you. You acknowledge and agree that it is your responsibility to review this site and this Acceptable Use Policy from time to time and to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment of the modified Acceptable Use Policy and agreement to abide and be bound by the modified Acceptable Use Policy.

As used in this Acceptable Use Policy, references to our "Affiliates" include our owners, subsidiaries, affiliated companies, officers, directors, suppliers, partners, agents, sponsors, and advertisers, and includes (without limitation) all parties involved in creating, producing, and/or delivering this site and/or its contents.

2. Adult-Oriented Content:
Kitchen41.com does not allow adult content and will suspend/terminate any offending account.

3. Obscene Speech or Materials:
Using Kitchen41.com's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Kitchen41.com is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

4. Defamatory or Abusive Language:
Using Kitchen41.com' network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.

5. Forging of Headers:
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

6. Illegal or Unauthorized Access to Other Computers or Networks:
Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities:
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

7. Facilitation a Violation of this AUP:
Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

8. Export Control Violations:
Exporting encryption software over the Internet or otherwise, to points outside the United States.

9. Usenet Groups:
Kitchen41.com reserves the right not to accept postings from newsgroups where we have actual knowledgethat the content of the newsgroup violates the AUP.

10. Other Illegal Activities:
Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

11. Other Activities:
Engaging in activities, whether lawful or unlawful, that Kitchen41.com determines to be harmful to its users, subscribers, operations, reputation, goodwill or customer relations.

As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the user. Kitchen41.com will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the comply with Kitchen41.com' policy or applicable law. However, when Kitchen41.com becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information.

Finally, Kitchen41.com may disclose subscriber information or information transmitted over its network where necessary to protect Kitchen41.com and others from harm, or where such disclosure is necessary to the proper operation of the system. However, Kitchen41.com will never sell information to other services or outside companies.
